Lasting Power of Attorney
With effect from 1st October 2007 this replaces the existing Enduring Power of Attorney (but any existing Power of Attorney remains valid).
Unlike Wills which only take effect on the death of an individual, Limited Powers of Attorney (POA) appoint people who will be able to deal with your affairs (i.e. to stand in your shoes as if they were you) should you become mentally or physically incapable of managing your own affairs.
Powers of Attorney can be prepared to become effective forthwith or more commonly deferred and only become operative if the DONOR (i.e. the giver of the power) becomes incapacitated as above.
The power can be given to anyone with their own mental capacity over the age of 18 and who is not bankrupt.
Such powers must however be registered with the Office of the Public Guardian.
